The Court directed that no coercive action be taken against Owaisi till April 24 and sought a reply from the government in two weeks.

A Single Bench of Justice Rajiv Gupta passed this order while hearing an application under section 482 filed by Asaduddin Owaisi.

Counsel for the applicant has submitted that the applicant is being prosecuted for the offence under Section 153(A) IPC, however, necessary sanction from the concerned authority as contemplated under Section 196(1) CrPC has not been taken and as such, entire proceedings are bad in the eye of law.

The Court observed that the matter requires consideration.

The Court has granted two weeks&#8217; time to file counter affidavits for the respondents.

&#8220;Till then, no coercive action shall be taken against the applicant in Complaint Case (MP/MLA) No 566 of 2022 (Rakesh Pratap Singh Vs Asaduddin Owaisi and Another), under Sections 153-A, 295-A, 298 IPC, Police Station Shohratgarh, District Siddharth Nagar, pending in the court of Chief Judicial Magistrate, Siddharth Nagar&#8221;, the Court ordered.

The Court has fixed the next hearing of the petition on April 24, 2023.

The Supreme Court on Tuesday listed a fresh petition filed by disqualified Lakshadweep MP Mohammed Faizal seeking permission to attend the Lok Sabha for hearing on March 29.

The Counsel appearing for the petitioner apprised the Bench of Justice K.M. Joseph and Justice B.V. Nagarathna that the Speaker today did not allow Faizal to sit in the Parliament. He sought instructions to the Speaker to withdraw the disqualification order.

The Apex Court, while noting that the plea was under Article 32, asked the lawyer as to which fundamental right was violated?

The Counsel replied that the MP’s right to represent his constituency had been violated.

The Bench asked whether it was a fundamental right? It further told the Counsel to approach the High Court under Article 226.

The lawyer then requested for taking up the petition tomorrow. The Supreme Court agreed and listed the same for hearing tomorrow.

Earlier on Monday, the Apex Court had agreed to list the petition, which sought permission to attend the Lok Sabha as his conviction has been stayed for March 28.

In his latest petition, Faizal has challenged the refusal of the Lok Sabha Secretariat to withdraw the decision to disqualify him, even after his conviction has been stayed by the High Court.

The matter was yesterday mentioned by Senior Advocate Abhishek Manu Singhvi before Chief Justice of India (CJI) D.Y. Chandrachud seeking urgent listing.

He submitted that the Supreme Court has refused to stay the Kerala High Court’s decision, which has suspended Faizal’s conviction. Despite that, the Lok Sabha Secretariat has not revoked his disqualification.

He added that the petition filed by the Lakshadweep Administration against the High Court’s order would come up for hearing before a Bench led by Justice K.M. Joseph tomorrow on March 28.

The CJI agreed to list the present matter along with the connected petition.

On January 11, 2023, a Sessions Court in Lakshadweep had convicted the NCP MP and three others to ten years imprisonment in an attempt to murder case relating to an incident of 2009. Following the conviction, Faizal, a two-time MP from the island, was disqualified and the Election Commission had announced by-polls to the constituency.

On January 25, the Kerala High Court had suspended Faizal’s conviction, while expressing concerns over the wasteful expenditure of a by-poll, especially when the term of the Lok Sabha was set to expire within one and a half year.

The Single-Judge Bench of Justice Bechu Kurian Thomas had also noted that no dangerous weapons were found to have been used by the accused in the case and that the wound certificates did not indicate any serious injuries.

Following the suspension of conviction, the Election Commission had decided not to act in furtherance of the press note for by-elections. The Lakshadweep administration had moved the Supreme Court against the High Court order. However on February 20, the Bench of Justice K.M. Joseph and Justice B.V. Nagarathna had refused to stay the High Court order.

The Delhi High Court has summoned Uddhav Thackeray, Aaditya Thackeray and Sanjay Raut on a civil defamation suit filed by Eknath Shinde faction leader Rahul Shewale for their statements against Shinde faction in relation the party symbol.

Justice Prateek Jalan declined to pass any interim order restraining the Thackerays and Raut from making any statements saying no interim order can be passed without hearing the defendants.

The Judge said that he does not want to pass a gag order on day one, an injunction against free speech in a political fight.

It was Shewale, the floor leader of Shiv Sena in the Lok Sabha,who moved to Court alleging that Raut had said that there was a deal of ₹2,000 crore following which the Shiv Sena name and bow and arrow symbol was allotted to the Eknath Shinde faction by the Election Commission by a recent order.

Senior Advocate Rajiv Nayar appeared for Shewale requested the court to pass an order to injunct Thackerays and Raut from making any further defamatory allegations.

However, the Court said that these are matters falling within political arena and it will pass orders only after hearing the defendants.

Nayar said that the defendants have made allegations against institutions like the Election Commission.

The Court responded by saying that institutions will have to stand up for themselves.

Nayar argued that the allegations are without any basis and should shock the conscience of the court, to which the judge sad that the question is not whether allegations conscience or not.

Justice Jalan added that the question is, in a free market place of ideas, are people entitled to say things which shock my conscience

The judge, however, also clarified that he was not condoning the language used or the allegations made.

He added that he does not want to pass a gag order in a political fight without hearing the other side.

The Supreme Court has instructed the government of Gujarat to file its reply on a petition by sacked IPS officer Sanjiv Bhatt for submitting additional evidence to support his appeal in the Gujarat High Court against his conviction in a 1990 custodial death case.

The appeal was filed by Bhatt in the High court challenging his conviction in the custodial death case of Prabhudas Vaishnani, who the Jamnagar police had caught hold after a communal riot.

A bench comprising Justices MR Shah and CT Ravikumar said no formal notice is required to be issued in the matter as senior advocate Maninder Singh has already appeared for the state.

The Supreme Court court has directed the Gujarat &nbsp;government for filing its reply by April 11 while posting the matter for hearing on April 18.

Sanjiv Bhatt was represented by Senior Advocate Devadatt Kamat, who said that the the Gujarat government has not filed its reply despite seeking several adjournments.

In the year 2019, a Sessions court in Jamnagar, Gujarat had&nbsp;convicted the ex-IPS officer in connection with a 1990 custodial death case, while sentencing him to life imprisonment.

The incident roots back to the tenure of Sanjiv Bhatt as the Assistant Superintendent of Police, Jamnagar, where he had taken over 100 persons into his custody for a riot incident in the area.

One of the rioters, who was in police custody for nine days, died of renal failure after being released on bail.

A criminal complaint was registered against Bhatt and other officers for the custodial death, and cognisance was taken by a Magistrate in 1995.

The former IPS officer was penalised with Indian Penal Code Sections of murder, causing grievous hurt, criminal intimidation and abetment.

In 2011, Justice Shah, who was then a High Court judge, had refused to set aside a trial court ruling that had rejected an application for deferment of framing of charges in the case.

Bhatt demanded in his letter to the Supreme Court recusal of Justice Shah on the grounds that the ends of justice will not meet if the present Special Leave Petition was being heard by the same judge.

Senior Advocate&nbsp;Devadatt Kamat, who appeared for Bhatt, had in January apprised the Supreme Court that the issue was about apprehension of bias, to which the Bench replied that a reasonable nexus has to be proved.

It is said that Bhatt is a vocal critic of the Narendra Modi government, who before his dismissal, had filed an affidavit before the Supreme Court, alleging that the Modi-led Gujarat government was complicit in the 2002 Gujarat riots.

In 2015, Sanjiv Bhatt was dismissed from service on the grounds of&nbsp;unauthorised absence from service.

An MP/MLA court in Prayagraj on Tuesday sentenced gangster-turned-politician Atiq Ahmed to life imprisonment in the 2006 kidnapping case of lawyer Umesh Pal, a key witness in the killing of Bahujan Samaj Party lawmaker Raju Pal.

The court further sentenced former corporator Dinesh Pasi and Khan Saulat Hanif to 14 years imprisonment under Section 364A (kidnapping a person, putting the person being put in danger of being murdered) of IPC among others.

The accused were convicted under Sections 147, 148, 149, 341, 342 and 120B of the Indian Penal Code.

Seven others, including Ahmed&#8217;s brother Khalid Azim alias Ashraf have been acquitted in the case.&nbsp;

Both Atique and his brother have also been accused of conspiring to kill Umesh Pal. Umesh was abducted in 2006 and forced not to give evidence against Atique and others. The FIR in this case was lodged by Umesh Pal in July 2007.

While the hearing was going on, local lawyers outside the courtroom premises raised slogans against Atiq Ahmed, saying &#8220;Fansi Do&#8221;.&nbsp;

Expressing their support to Umesh Pal, who was also a lawyer, the Advocates demanded strictest punishment for Atiq Ahmed.

A scuffle broke out between the Advocates of both parties inside the MP-MLA Prayagraj court during the hearing of Umesh Pal kidnapping case.&nbsp;

Earlier in the day, the Supreme Court had dismissed as withdrawn a petition filed by Atiq Ahmed, seeking protection during shifting from Sabarmati jail in Gujarat to Uttar Pradesh in connection with the Umesh Pal kidnapping case.

The Bench led by Justice Ajay Rastogi refused to grant security to the gangster-turned-politician on the grounds that this court was not inclined to entertain such pleas. The Apex Court further directed the petitioner to approach the High Court for relief.

Umesh Pal was a key witness in the murder of BSP MLA Raju Pal, who was killed in 2005 allegedly on the directions of Ahmed. The SP leader was the prime accused in the 2005 murder of Raju Pal. He was further accused of hatching Umesh Pal’s murder conspiracy from inside Gujarat’s Sabarmati jail, where he is currently lodged.

On February 24 this year, Umesh was gunned down outside his residence in Sulem Sarai area of Prayagraj in broad daylight. Umesh and one of the policemen, identified as Sandeep Nishad, had died, while another security personnel, Raghvendra Singh, suffered critical injuries in the incident.

The Supreme Court has decided to hear the plea filed by the Hindu parties to consolidate all suits concerning Gyanvapi Kashi Vishwanath dispute which are pending before the Varanasi Court on April 21.

The case was mentioned before the bench of Chief Justice of India (CJI)&nbsp;DY Chandrachud, Justices&nbsp;PS Narasimha&nbsp;and&nbsp;JB Pardiwala&nbsp;for urgent listing by by advocate Vishnu Shankar Jain.

The Advocarte said that the Varanasi district court was not passing an order on the issue.

The Top court then assured the petitioner that the case will not be deleted from the list on its upcoming date of hearing.

The Gyanvapi dispute began soon after the Hindu devotees approached a civil court claiming the right to worship inside the premises of the Gyanvapi Mosque, on the premise that it was a Hindu temple and still houses Hindu deities.

A survey of the mosque was ordered by the civil court under an advocate commissioner. The advocate commissioner then conducted the videographed survey and&nbsp;submitted a report to the civil court.

The Hindu parties on the basis of the survey claimed that one of the objects discovered at the site is a Shivling while the Muslim parties have disputed the same and said that it is only a water fountain.

The suit before the civil court then was&nbsp;transferred to the District Judge by the Supreme Court&nbsp;on May 20 in view of the sensitivity of the issue involved.

The District Court, held that the suit was not barred under the Places of Worship (Special Provisions) Act, 1991.

A Varanasi court found that the suit filed by Hindu parties seeking possessory rights over Gyanvapi Mosque maintainable.

This decision was appealed before the High Court by the by Committee of Management of Anjuman Intezamia Masjid which&nbsp;reserved its verdict&nbsp;in December.

The High Court also&nbsp;asked the Director General of ASI&nbsp;to submit his opinion on whether carbon dating, Ground Penetrating Radar (GPR), excavation and other methods to determine the age of the disputed object at Gyanvapi mosque, would damage the object.

The Supreme Court on Tuesday dismissed as withdrawn a petition filed by gangster-turned-politician Atiq Ahmed, seeking protection during shifting from Sabarmati jail in Gujarat to Uttar Pradesh in connection with the murder case of Umesh Pal Yadav.

The Bench led by Justice Ajay Rastogi refused to grant security to the gangster-turned-politician on the grounds that this court was not inclined to entertain such pleas.

The Apex Court, while noting that the State machinery will take care of him, directed the petitioner to approach the High Court for relief.

The petitioner contended that the threat to his life was continuing, as an open threat has been issued on the Floor of the House.

Atiq, an accused in the murder case of Umesh Pal Yadav, moved the Supreme Court on March 1, apprehending a fake encounter at the hands of Uttar Pradesh police.&nbsp;

Advocate Hanif Khan filed the application on behalf of Ahmed, stating that he should not be shifted from Sabarmati jail in Gujarat, where he was currently lodged in connection with kidnapping of a businessman, for hearing in the Umesh Pal murder case in Uttar Pradesh, as there was a threat to his safety and life.&nbsp;

The petition contended that taking in view the statements of some Ministers in the UP government, it looked like that a fake encounter of the former Samajwadi Party leader could take place during his shifting from Gujarat to Uttar Pradesh.

The petition placed reliance on a statement by Uttar Pradesh Chief Minister Yogi Adityanath saying that the mafia and the accused would be razed to the ground.&nbsp;

Deputy Chief Minister Brajesh Pathak has also expressed the possibility of overturning of vehicles, noted the plea.

The petitioner said that if it was urgent to bring him to UP, then he should be brought under the protection of the Central Force. Otherwise, trial in all his cases should be conducted through video-conferencing only, he added.

The plea further contended that if interrogation by Uttar Pradesh police was necessary, then this should be done in Gujarat itself under the supervision of the Gujarat Police around the court premises.&nbsp;

Umesh Pal was a key witness in the murder of BSP MLA Raju Pal, who was killed in 2005 allegedly on the directions of Ahmed.

The SP leader was the prime accused in the 2005 murder of Raju Pal. He was further accused of hatching Umesh Pal’s murder conspiracy from inside Gujarat’s Sabarmati jail, where he is currently lodged.

On February 24 this year, Umesh was gunned down outside his residence in Sulem Sarai area of Prayagraj in broad daylight. Umesh and one of the policemen, identified as Sandeep Nishad, died, while another security personnel, Raghvendra Singh, had suffered critical injuries during the shootout.

The Uttarakhand High Court dismissed a Public Interest Litigation (PIL) filed claiming that the lands belonging to someone has illegally acquired the villagers of several villages for the development of the Alaknanda (AHPL) Dam.

The petitioner (Dinesh Chauhan) seeks the relief that the lands of the villagers should be acquired afresh under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Other related reliefs have also been sought by the petitioner.

The Division Bench of Chief Justice Vipin Sanghi and Justice Alok Kumar Verma is of the view that the present petition, as a public interest litigation, is not maintainable, since the petitioners whose lands are alleged to have been illegally acquired can, and should, raise their grievance in their own name by filing their own petition(s), if they have any grievance in that regard.

&#8220;This Court cannot presume that the original land owners have any outstanding claims or grievance in regard to the acquisition of their land.&#8221;

The contention of counsel for the petitioner is that the land owners are poor, and they cannot afford to file writ petitions. The Bench cannot accept this submission. The fact that they were land owners itself negates this submission of counsel for the petitioner , observed the Bench.

The&nbsp;Supreme Court&nbsp;has questioned the Union government decision to ban only three out of 27&nbsp;pesticides from&nbsp;its draft notification.

The Supreme Court has also asked the Central government for placing on record two expert committee reports relating to harmful pesticides.

A bench headed by CJI DY Chandrachud questioned the additional solicitor general Vikramjit Banerjee for explaining the rationale behind choosing only three of the 27 pesticides to be banned.

The Court was currently dealing with a bunch of petitions that demanded ban on over 100 pesticides still in use in India despite being banned in western world for their harmful effects on children.

The ASG Vikramjit Banerjee said that Centre in its status report has explained the process of evaluation and has nothing to hide.

Talking about the petitioners for continuously expanding the list of pesticides to be banned in India, the ASG said that the court should not be used as a forum for corporate warfare.

The ASG said that there is a robust regime in place to continuously evaluate the pesticides and their effects on human beings.

He added that just because certain pesticides are banned in the USA, it does not mean these should be banned in India. Our climatic, soil and agricultural conditions are very different from the USA.

The CJI-led bench said the draft notification by the Centre was based on reports by committees headed by Dr S K Khurana and Dr T P Rajendran, which listed out 27 harmful pesticides.

The bench said that the government had accepted the recommendations and decided to ban them. What made you ban only three? We want to be satisfied about the nature of the process followed.

The ASG said the government has nothing to hide and would put the reports of the committees before the court., but questioned the evaluation of petitioner to decide which pesticide to be banned, which is clearly the exclusive work of the government

The bench asked the government to file a fresh status report explaining the process and also place on record the reports of the two committees within four weeks.

The Madhya Pradesh High Court issued a show cause notice to the chairman of the State Bar Council all the other elected member of the State Bar Council asking for an explanation why should there be no criminal contempt of court proceedings against them for compelling lawyers to abstain from judicial work.

The Single-judge Justice&nbsp;Atul Sreedharan said that the strike which was called by the the chairman and the elected members of the State Bar Council was violation and defiance of the order passed by the High Court on March 24 in a suo motu case initiated by the Court in wake of the strike.

The Justice thus ordered that the registry of the Court to register a criminal contempt of court case against them.

The calling of strike against the authorities by the Chairman of the Madhya Pradesh State Bar Council and its elected Members amounts to criminal contempt as defined under Section 2(c)(ii) or (iii).

The Registry has been directed to register a criminal contempt case against the Chairman of the State Bar Council and all the other elected member of the State Bar Counci.

It has been directed to issue notice to them for the decision taken by the Court to prosecute them for criminal contempt of court on account of them having compelled the lawyers to abstain from judicial work which is interfering and obstructing the administration of justice in the State.

A large number of Advocates of Madhya Pradesh had gone on strike against a policy of the administration of the High Court to dispose of long-pending cases in district courts.
