Interest Litigation (PIL) filed for renovation/new construction of the College Building of Rajendra College, Chapra, which is the oldest college of Jay Prakash University, Chapra. </p> <p>The contention was also that the building was about 100 years old and it is not safe for the students who are studying in the College and also for the teaching and non-teaching staff of the College. </p> <p>A supplementary counter affidavit dated 23.06.2023 has been filed by the Deputy Director, Higher Education, Patna. </p> <p>It is stated that the Education Department sanctions work on the basis of Schemes put forth for grants and disbursement of funds for development work in the Universities; which work is carried out by the Bihar State Educational Infrastructure Development Corporation (BSEIDC). </p> <p>The Vice Chancellor, Jai Prakash University, Chapra (Respondent No.6) has furnished projects for development work of the University and Colleges. By letter dated 13.05.2022 scheme is forwarded for Rajendra College, Chapra, development works. </p> <p>The Director, Higher Education, Education Department, Government of Bihar, Patna (Respondent No.5) was also intimated. <br>The Managing Director, BSEIDC is to co-ordinate with the Registry of the Jay Prakash University and Principal, Rajendra College, Chapra, to draw up an estimate for the expenses to be incurred for new construction/renovation works. It is also undertaken that immediately on estimate being received by the Department, further action will be taken.<br>The said undertaking is recorded and the petition is disposed of by the Division Bench of Chief Justice K. Munir passed this order while hearing a petition filed by Avnish Tandon.</p> <p>The petitioner has come up, challenging the order dated 08.01.2023 passed by the Assistant General Manager and the Regional Head, Bank of Baroda, Bareilly rejecting the petitioner’s application seeking compassionate appointment in his mother’s stead. </p> <p>The petitioner’s mother was a Cashier-cum-Clerk in the erstwhile Bareilly Corporation Bank, which subsequently merged with the Bank of Baroda in 1999.</p> <p>Counsel for the petitioner emphasizes that the Bareilly Corporation Bank (BCB), before the merger too, was maintained by the Bank of Baroda (BOB). The petitioner’s mother died in harness on 12.11.1996, leaving behind the petitioner, then a minor, besides a minor daughter.</p> <p>The petitioner passed his B.Com examination in the year 2007 and made an application for compassionate appointment. The petitioner has brought to the Court’s notice the fact that he has been pursuing his claim with the BOB, post merger, for compassionate appointment unsuccessfully since the year 2007. In the year 2022, finally, he moved this Court, seeking a direction for consideration of his claim.</p> <p>The direction to consider the petitioner’s case was issued because the Bank seems to have invited some application from the petitioner on 23.03.2022 regarding his claim for compassionate appointment.</p> <p>Nevertheless, the Court was mindful of the fact that the claim was highly belated, a fact that is reflected in the order of the Court made on 31.05.2023. The Bank was left free to take a decision in the matter, strictly in accordance with law.</p> <p>The Court noted that,</p> <p>It is in the context of the aforesaid direction that the impugned order has been passed by the Bank, declining the petitioner’s case on two counts. The first is that the petitioner’s mother was an employee of the BCB, which was a separate entity, and she died before its merger with the BOB in the year 1999. The other was that the claim was one made nearly 26 years after the event.</p> <p>The Court is not minded to look into the validity of the reason carried in the impugned order that the petitioner’s mother died before the merger. The Court is also not impressed by what the Bank has said about the 26 years delay on the petitioner’s part in approaching the Bank.</p> <p>“It does appear that the petitioner approached the Bank soon after he passed his B.Com examination. The fact on which the fate of the case would turn is that the petitioner waited too long in commencing any kind of action to enforce his rights, if these were there. He pursued the matter with the Bank from the year 2007 right up to the year 2022, when for the first time, he instituted a writ petition before the Court. Prior to the year 2022, the petitioner did not bring any kind of action before any judicial forum to enforce his rights.</p> <p>Apart from this feature of the matter, what is most important is that 26 years have indeed elapsed since the petitioner’s mother passed away. During this long passage of time, as life goes on, it is a legitimate inference to draw that the financial crisis emanating from the petitioner’s mother’s untimely demise would have been tided over by the petitioner, in whatever way it was. There is, therefore, no existing exigency to bail out the family in economic distress now, in aid of which the Court may issue a mandamus to consider the petitioner’s case.</p> <p>In this view of the matter, the Court does not find any good ground to interfere”, the Court observed while dismissing the petition.</p> <p>The post <a rel="nofollow" Maheshwari and Justice K.V. Viswanathan passed the order on Monday on two petitions challenging the appointment of Varghese. </p> <p>The Apex Court observed that the appointment would be subject to the outcome of pleas filed by the University Grants Commission (UGC) and Dr. Joseph Skariah. </p> <p>The Apex Court directed both the petitioners to respond to each otherβs appeal.</p> <p>Skariah, who was ranked next to Varghese in the list of candidates considered for the post, moved the Kerala High Court against the appointment.</p> <p>A Single-Judge Bench of the High Court ruled in November, 2022 that Varghese did not have the requisite teaching experience to be appointed to the post. </p> <p>She challenged this ruling before a Division Bench of the High Court, which observed last month that her candidature could be considered after also factoring the period spent by Varghese in pursuing her PhD under the faculty development programme and the time spent on deputation as Director of Student Services of the National Service Scheme of Kannur University.</p> <p>The Division Bench further criticised the media for giving undue attention to the case while it was being adjudicated before the Single-Judge Bench.</p> <p>Both the UGC and Dr. Skariah have moved the Apex Court against the Division Bench decision. The appeal by Dr. Skariah was filed through Advocate Atul Shankar Vinod.</p> <p>Varghese is married to K.K. He requested the Bench to stop the national agency, stating that Solicitor General Tuishar Mehta was present in the court.</p> <p>The top court of the country then ordered the CBI to wait for some time and said that the Apex Court would take up the matter at 2 pm.</p> <p>The SG assured the Bench that the orders would be followed. However, he argued that if CBI had not done anything, Senior Advocate Kapil Sibal would have accused them of inaction. He further said that recording of statements was done in good faith.</p> <p>Earlier on Monday, the Bench of Chief Justice of India D.Y. Chandrachud, Justice J.B. Pardiwala and Justice Manoj Misra had said that it would hear all petitions related to violence against women in Manipur together.</p> <p>Senior Advocate Kapil Sibal appeared for the two women belonging to the Kuki-Zomi community of Manipur, who were stripped, paraded naked and allegedly sexually assaulted on May 4.</p> <p>The women had moved the Apex Court seeking probe by a special investigation team (SIT), led by an independent IG rank police official and transfer of trial outside the state. </p> <p>Sibal said the two women have expressed no faith in state police and sought security for them while seeking a direction for recording of their statement under Section 164 CrPC by the nearest area magistrate.</p> <p>The Senior Advocate contended that the petitioners were challenging the Central governmentβs decision to transfer the probe to the Central Bureau of Investigation, as well as the Union governmentβs demand to transfer the probe out of Manipur. </p> <p>The Apex Court had taken suo motu cognisance of the issue on July 20 and directed both the Union and the state government to apprise it about the steps taken to bring the perpetrators of crime to book. </p> <p>The Bench led by Chief Justice of India D.Y. Chandrachud had come down heavily on both the Centre and the state over the video of two women, who were paraded naked in Manipur on May 4. Calling it as βdeeply disturbing,β the Apex Court said the visuals showed βgrossβ constitutional failure by the government, adding that If the government did not act, the Supreme Court would. </p> <p>The Union government then filed an affidavit in the Apex Court, stating that it had transferred the probe to the Central Bureau of Investigation (CBI). The Centre said that it had taken the step with the consent of Manipur government, considering the gravity of the offence. </p> <p>Filed by the Ministry of Home Affairs, the affidavit urged the Apex Court to transfer the trial out of Manipur to any other state. The three-Judge Vacation Bench of Justice B.R. Gavai, Justice A.S. Bopanna and Justice Dipankar Datta stayed the Gujarat High Court order, which directed Setalvad to surrender immediately before the Gujarat Police and listed the matter for hearing before a regular Bench of the Apex Court.</p> <p>Earlier on July 1, the High Court of Gujarat had refused to grant bail to Setalvad. The order was passed by the Single-Judge Bench of Justice Nirzar Desai.</p> <p>Appearing for Setalvad, Senior Advocate Mihir Thakore had requested the High Court to stay the operation of the verdict for 30 days. However, the Single-Judge bench rejected the request and directed Setalvad to immediately surrender before the police.</p> <p>Gujarat Police had arrested the activist on June 25, 2022 on alleged charges that she fabricated documents to frame high-ranking officials, including the then Gujarat Chief Minister Narendra Modi in cases related to violence that took place in Gujarat after the Godhra train burning incident in 2002. </p> <p>Setalvad, who is also the Secretary of Citizens for Justice and Peace, an organisation formed to fight for the victims of 2002 Gujarat riots, was kept in police remand for seven days and sent to judicial custody on July 2.</p> <p>On September 2, 2022, the Supreme Court had granted interim bail to Setalvad, directing her to surrender her passport till the matter was taken up by the High Court and ensure complete cooperation in the investigation.</p> <p>The Bench of then Chief Justice of India Uday Umesh Lalit, Justice Ravindra Bhat and Justice Sudhanshu Dhulia had further directed the Gujarat Police to release Setalvad on conditions, which the court deemed appropriate.</p> <p>The Bench observed that Teesta Setalvad, a lady, has remained in custody since two months and the investigative machinery has had the advantage of custodial interrogation for a period of seven days.</p> <p>The top court of the country had noted that the offences alleged against Teesta pertained to 2002 and at best, the concerned documents were sought to be produced by 2012.</p> <p>Thus, the essential ingredients of investigation, including custodial interrogation having been completed, the matter assumed a complexion where the relief of interim bail was evidently made out, noted the Apex Court and granted interim bail to Teesta.</p> <p>On September 1, 2022, the Apex Court had pulled up the Gujarat High Court over its order to list Setalvadβs bail plea for hearing on September 19, almost six weeks after issuing notice in the case.</p> <p>Stating whether this was the βstandard practice in Gujarat,β the top court of the country had asked the government of Gujarat about the material they had gathered in the past two months against Setalvad.</p> <p>The then CJI-led Bench had further noted that there was no grave offence, such as Prevention of Terrorism Act (POTA), 2002 or the Unlawful Activities (Prevention) Act, 1967, meaning that there was no statutory mandate against the grant of bail.</p> <p>The top court of the country added that a lady was entitled to βfavoured treatmentβ in normal offences under Section 437 of the and sentence handed down to Gandhi by a Magistrate court.</p> <p>It was further said that ,the petitioner far from being repetant and contrite, displayed arrogance.</p> <p>The complainanat said that the petitioner has maliciously and recklessly used scurrilous words against a large and totally blameless class of persons, who have caused no harm to him.</p> <p>The reply was filed in response to the a plea by Gandhi seeking stay on the conviction and two-year jail term imposed on him by a Magistrate court in Gujarat’s Surat.</p> <p>The now disqualified parliamentarian was convicted by the Polling took place on 26.04.2021 whereby after counting, the petitioner was declared as the winning candidate with the margin of 04 votes from the runner up candidate; Javed.</p> <p>ii) The respondent no 3, who was defeated by margin of 04 votes, preferred election petition under Section 12(c) of Uttar Pradesh Panchayat Raj Act, 19471 on 01.07.2021 stating therein that at the time of counting, Dr. Minzar s/o Abrar, Bhura s/ o Yusuf and Alam s/o Nanhe colluded with the petitioner and seven ballots votes cast in favour of respondent no 3; Javed were declared invalid and one vote was kept in other category. Despite objections being raised by respondent no 3; Javed before Assistant Returning Officer/Returning Officer, nothing was done.</p> <p>iii) In the aforesaid election petition, the notices were issued to the other parties and on 19.05.2023, the said election petition was dismissed by Prescribed Authority/Sub Divisional Magistrate for want of prosecution. </p> <p>Thereafter, on 26.05.2022, the respondent no.3 filed recall application and by order dated 01.07.2022, the order dated 19.05.2022 was recalled and the matter was fixed for 21.07.2022 directing the petitioner (respondent in election petition) to file written statement before the court below.</p> <p>iv) The petitioner has filed his written statement on 14.12.2022 to which rejoinder has been filed on 06.02.2023 by respondent no 3, thereafter, date was fixed for framing of issues. On 31.05.2022, the S.D.M Bilari had framed nine issues and closed the opportunity for producing the evidence and fixed the matter for final hearing on 07.06.2023.</p> <p>v) subsequently, without providing an opportunity to the parties to appear for the statement and cross examination, the impugned order dated 20.06.2023 has been passed directing for recounting of votes. Hence the petition has been filed.</p> <p>Counsel for the respondent no 3 has raised preliminary objection regarding maintainability of writ petition on the ground that against the order dated 20.06.2023 directing for recounting of votes, the petitioner had statutory remedy of filing a revision under Section 12-C (6) of the Act, 1947, therefore the writ petition is not maintainable.</p> <p>Counsel for the petitioner submitted that the impugned order for recounting has been challenged on the ground that every election petition has to be tried by the Sub Divisional Officer following the procedure applicable under the Code of Civil Procedure, 1908. The Presiding Officer proceeded in a hurried manner to decide the election petition without adopting the legal procedure, which has to be followed.</p> <p>The Prescribed Authority has framed nine issues, however, without taking any evidence, has closed the opportunity of providing evidence and fixed the case for final hearing. Though issues have been framed, but no findings with respect to the same has been recorded and that too without providing opportunity to the parties to appear for the statements and cross-examinations, which is against the provision of the C.P.C., which has to be followed while deciding the election petition.</p> <p>He further submitted that though the respondent no 3 has taken an objection with respect to collusion of the counting agents, declaring 7 ballot votes cast in favour of the respondent no 3 as invalid, but no findings in this regard has been recorded while passing the impugned order. Only vague and false allegations have been made in the election petition, there being no evidence of either oral or documentary in support thereof.</p> <p>The Prescribed Authority, on the basis of complaint and evidence adduced by the petitioner in the election petition (respondent no 3 herein) has recorded that there is difference of 4 votes between the petitioner and respondent no 3 and has passed the impugned order directing for recounting, which cannot be sustained in the eye of law.</p> <p>On the other hand, Standing Counsel as well as counsel for the respondent no 3 has opposed the submission made by the counsel for the petitioner and submitted that nine issues have been framed and after analysing the specific averments made in para 9 & 10 of the election petition wherein it was mentioned that 7 valid votes cast in favour of the petitioner were declared invalid in collusion with the counting agents, i.e Dr Minzar s/o Abrar, Bhura s/o Yusuf and Alam s/o Nanhe, the impugned order of recounting has been passed, hence there is no illegality in the aforesaid order.</p> <p>The Court found that Rule 4 of the UP Panchayat Raj Act (Settlement of Election Disputes) Rules, 19943 clearly provides that subject to the provisions of the Act and these Rules, every election petition shall be tried by the Sub Divisional Officer, as nearly as may be, in accordance with the procedure applicable under the Code of Civil Procedure, 1908 for the trial of suits.</p> <p>“In view of the above, the election petition has to be tried in the same manner as a civil suit is tried by the civil court, i.e to say that apart from the pleadings of the parties, issues have to be framed, documentary evidence has to be laid, statements of witnesses have to be recorded, they have to be cross-examined, and only thereafter, after recording findings on all the issues, either separately or jointly, the election petition can be decided.</p> <p>In the case, the procedure prescribed in Rule 4 has been violated and despite the fact that 9 issues were framed during the course of the trial of election petition, none of the said issues has been decided and directly, an order of recount of votes has been passed.</p> <p>It is well settled in catena of decisions of the Court as well as the Apex Court that the secrecy of ballot has to be maintained and an order of recount cannot be passed as a matter of choice of the parties and it requires a very critical analysis of the material placed and in accordance with the procedure prescribed for deciding election disputes.</p> <p>In the case, the Prescribed Authority/Sub-Divisional Magistrate has exercised its jurisdiction of recounting only on the basis of roving inquiry without substantial ground or evidence on record. People who come from the Bar have longer tenures. I’m not undermining anybody, but those coming from services come at an age when they are already at the age of retirement. It may not affect the quality. It alleged that police used lathi charge, water cannon and tear gas shells to disperse the crowd, which resulted in a chaotic situation.</p> <p>Drawn by Advocate Barun Kumar Sinha, the petition The counsel for the Registry of the Tribunal states that even at Nagpur, the Division Bench is not functioning.</p> <p>The response of the Tribunal is also placed on record, which states that process for appointment is going on. An affidavit is filed on behalf of the Registry of the Tribunal. It is stated that, at present, there is one Judicial Member and one Administrative Member at Aurangabad and the Administrative Member is due to superannuate on 11 August 2023 and the Judicial Member is superannuated on 28 June 2023 and, therefore, effectively from 11 August 2023 there will be only Vice-Chairman (Judicial) in the Tribunal at Aurangabad. The affidavit also mentions the process of filling up of the vacancies.</p> <p>When the matter was called out in the morning session, it was kept back for the learned Advocate General to assist the Court. The Advocate General has appeared and has assisted the Court.</p> <p>A communication dated 19 July 2023 issued by the Under Secretary to the Government of Maharashtra, General Administration Department to the Joint Secretary (AT), Government of India, Ministry of Personnel, P.G. & Pensions, Department of Personnel & Training, New Delhi is placed on record, whereby the request is made to issue appointment orders to the two selected candidates as regard Member (Administrative), Nagpur and Member (Administrative), Aurangabad. The counsel representing the Registry of the Tribunal informs that as regard two Judicial Members, recommendation is already sent to the Government of India in June 2023.</p> <p>Considering the importance of the Tribunal and the situation resulting from non-filling of the vacancies which is extremely prejudicial to the litigants, the Joint Secretary, Government of India, would look into the issue on priority basis and will consider taking necessary steps at the earliest, the Court directed.</p> <p>The counsel for the Union of India states that these observations and sentiments expressed by this Court would be conveyed to the Joint Secretary, Government of India at the earliest.</p> <p>The counsel for the Petitioners states that this process may take some time and in the meanwhile, though the Tribunal at Mumbai is taking up urgent matters, facility be provided for virtual hearing and e-filing so that the Advocates need not come to Mumbai physically. On this aspect, the Chairperson of the Tribunal would be in better position to take a decision depending on the availability of the infrastructure and feasibility.</p> <p>“If there is a shortage of infrastructure because of which the virtual hearing cannot be provided, we have no doubt that the Chairperson of the Tribunal would make necessary request to the State Government and further we have no doubt that the State Government will extend all possible assistance”, observed the Division Bench of Acting Chief Justice Nitin Jamdar and Justice Arif S.
