Important News for All CBSE Schools: New Labour Law Requirements

CBSE schools are governed by a set of rules and regulations. As part of these rules, CBSE schools are required to comply with various labour laws. Following the new circular issued by EPFO with regards to CBSE affiliated schools, it is mandatory for the respective schools to be compliant with the labour laws which include ESI, EPF, Minimum Wages, POSH, and Maternity Benefit amongst others.

Now the question is, why labour law is required for schools? 

Earlier, there were mandatory provisions in place to maintain ESIC & EPF, but there were mass reports of non-compliance from the schools end. The government wants to expand coverage of its social security schemes and bring more workers under their ambit, focusing on creating a compliant environment to ensure fair and just treatment of their employees.

Here are some of the labour laws that CBSE schools need to comply with:

  1. Minimum Wages Act: The Minimum Wages Act sets the minimum wage rate that employers must pay their employees [non-teaching staff]. CBSE schools must adhere with this Act and pay their employees the mininum wages set by the government. 

  2. Employees' Provident Fund Act: The EPF Act requires employers to grant a certain amount of money to the PF account for their employees. CBSE schools must comply with this Act and contribute to their employees' provident fund accounts.

  3. Employees' State Insurance Act: The Employees' State Insurance Act mandates that employers provide health insurance coverage to their employees. This applies to CBSE schools & must be followed by them to provide health insurance coverage to their employees. 

  4. Payment of Gratuity Act: The Payment of Gratuity Act requires employers to pay a gratuity to employees when they retire or resign. CBSE schools must follow this Act and provide gratuity to employees who meet the eligibility requirements.

  5. Maternity Benefit Act: Under the Maternity Benefit Act, employers are required by law to provide maternity leave and benefits to their female employees. CBSE schools must follow this Act and provide maternity leave and benefits to female employees.

  6. Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act: The Sexual Harassment of Women at Workplace Act entails employers to create a harassment-free workplace for their female employees. CBSE schools must comply with this Act and take appropriate measures to protect their female employees from sexual harassment.

Ultimately, CBSE schools must follow various labour laws to ensure that their employees are treated fairly and lawfully. Compliance with these laws not only protects employees' rights, but also contribute significantly to the establishment of an encouraging work environment.
